Immediately upon receiving a citation or being arrested, you need a lawyer. Even if you receive a citation, I can make sure that you get treated properly and I can save you having to go to court more than is absolutely necessary. For a citation or a felony and everything in between, the first appearance is to make sure you know your constitutional rights and to make sure you have a lawyer if the law requires it. If I notify the court that I am representing you than the first appearance becomes unnecessary. Their is no such thing as knowing your rights before you need to. So call me if I can help.
RIGHT TO WORK = RIGHT TO FIRE
Nevada is what’s called a right to work state. But don’t be fooled by its name. Right to Work, like so many other names (Patriot Act being the most obvious) means the opposite of what it’s called. Right to work means that unless you have a contract or a union or some other method of proving specific terms of employment, your employer can fire you because they want to with or without a reason. Sure they can’t fire you because of your disability, age, sex, religion or color. But proving it was for one of the few protected reasons is very hard to do. This is good for employers and bad for employees. Certainly most employers will not fire a good employee on a whim (they wouldn’t be in business long), but they can if they want to.
People often come to me because they signed a contract and have come to realize that it is not what they believed. They eventually tell me that they either signed it without reading it or signed it without understanding it.Neither of these are valid reasons to get out of a contract. While I may be able to find a way to get you out of a contract, I guarantee you that it will cost more to get you out of the contract than it would have if you would have brought it to me before you signed it. Additionally, if I determine that you are stuck in the contract, you still end up paying for me to make that determination.What it comes down to is this, your signature is valuable. Once you have given away your signature, it may be too late. So when that pen is in your hand and a contract is in front of you, make sure you have NO doubt. If you do, bring it to me first so you can be sure that you understand what you are doing.
A new problem has been created by the Nevada Legislature. If you get a prescription for marijuana and legally obtain it and legally use it, it could still be illegal for you to drive for up to 30 days. A federal study has shown that metabolytes could remain in your system for up to 30 days in an amount that Nevada DUI laws still consider illegal. In other words, you are no longer under the influence and maybe haven't been for almost a month and yet, your blood has metabolytes that make it illegal for you to drive. I am quite sure that most people in this position are unaware of the problem thay could find themselves in. I am also of the opinion that the legislature doesn't care to solve the problem. So be careful.
If there is one thing I could tell you about your car or motorcycle insurance, it is that you need to have Uninsured/Underinsured coverage. Preferably, you should have at least $50,000 in coverage.
We are being told that at least 1 out of 4 drivers are uninsured. If you are injured by an uninsured driver, you will have no viable way of being compensated for your injury without uninsured motorist coverage.
Additionally, with the cost of emergency room and hospital care being what it is, if you are hit by someone with the minimum coverage required by law, only the hospital may end up getting paid for your emergency room visit (although there are ways around part of this).
In Nevada, Uninsured coverage is also Underinsured coverage. This is coverage which is cheaper than the required coverage and if you have to use this insurance, your rates will not go up as you were not at fault in any accident where you would use this coverage.
